These Terms and Conditions ("Terms") govern your access to and use of the DeliverIT website and platform at deliverit.io ("DeliverIT," the "Service"), operated by DeliverIT ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
DeliverIT lets you describe, build, preview, and publish web applications with the help of AI, and create AI assistants ("agents") that can communicate through in-app chat, SMS text messaging, and email. Some features, including agent phone numbers, agent email addresses, and publishing to production, require a paid subscription.
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service.
When you enable an agent's phone number or add a phone number as an authorized contact, you consent to receive text messages from DeliverIT agents at that number. These messages include one-time verification codes and conversational replies from agents you or your organization have configured.

You agree not to use the Service to:
We may suspend or terminate accounts, agents, phone numbers, or email addresses that violate these Terms or create risk for DeliverIT, carriers, or other users.
You retain ownership of the content you provide and the applications you build. You grant us a limited license to host, process, and transmit that content as needed to operate the Service, including sending it to the AI model and communications providers that power the features you use. You are responsible for the applications you publish and the agents you operate, including the content of messages they send at your direction.
The Service uses artificial intelligence to generate applications, code, and agent responses. AI output may contain errors or inaccuracies. You are responsible for reviewing output before relying on it or publishing it. Agent-proposed changes to your applications are staged as drafts and applied only with your approval.
Paid plans are billed in advance on a recurring basis and renew automatically until canceled. You can cancel at any time, effective at the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice; changes apply from your next billing period. Usage limits (such as agent message rates and daily AI budgets) apply per your plan.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, create legal or security risk, or if we discontinue the Service. Upon termination, provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MESSAGES WILL BE DELIVERED WITHOUT DELAY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELIVERIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
